Desmond T. McIlwain is Of-Counsel to the firm. He is a graduate of The College of William and Mary (1992) and the University of Baltimore School Of Law (1995).
Prior to joining Tobin, O’Connor & Ewing, Mr. McIlwain was an Associate General Counsel of Litigation for a company with over nineteen thousand employees in the transportation industry. He has also worked at a management–side labor and employment law firm as well as for the U.S. Department of Labor, in what is now known as the Employee Benefits Security Administration, focusing on fiduciary, reporting and disclosure, and other compliance issues for employee benefit plans and for a management-side labor and employment law firm. Additionally, Mr. McIlwain has served as an adjunct professor in the paralegal studies program at Baltimore City Community College teaching employment law in the paralegal studies program.
Since joining Tobin, O’Connor & Ewing, and as he has throughout his career, Mr. McIlwain has represented management clients across a wide spectrum of industry areas including teaching hospitals, medical professional associations, software, technology and consulting companies in: employee benefits and compensation, plan drafting, labor and employment law issues including, defense of discrimination and harassment claims, wage and hour matters, OSHA compliance, drug-testing, unionization, restrictive covenants and collective bargaining.
